TERMS OF SERVICE

Welcome to FIRSTIES ("we," "our," or "us"). By downloading, accessing, or using the Firsties mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes your acceptance of the new Terms.

Firsties is a social networking application that connects users who share the same first name. The App allows users to:

• Create a profile associated with their first name
• View and interact with posts from other users who share their name
• Participate in name-based community features and activities
• Send goodnight messages to other users with the same name
• Participate in community games and challenges

You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent or guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

You retain ownership of content you post on the App ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and providing the App.

You are solely responsible for your User Content and represent that:

• You own or have the right to post such content
• Your content does not violate the rights of any third party
• Your content complies with all applicable laws and these Terms

You agree not to:

• Use the App for any unlawful purpose or in violation of any laws
• Post content that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation
• Post spam, advertisements, or solicitations without authorization
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App or servers
• Collect or harvest user data without consent
• Use automated means to access the App without our permission
• Bully, harass, or intimidate other users
• Post content depicting violence, self-harm, or illegal activities

The App and its original content (excluding User Content), features, and functionality are owned by Firsties and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• The results of using the App will meet your requirements

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FIRSTIES, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

You agree to defend, indemnify, and hold harmless Firsties and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the App, your User Content, or your violation of these Terms.

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App or delete your account through the App settings.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.
